Newark does not have its own marriage license office. All applications go through the New Castle County Clerk of the Peace in Wilmington. The Marriage Bureau is at 800 N. French Street, 2nd Floor, Wilmington, DE 19801. That's about a 15-minute drive from Newark depending on traffic. Phone: (302) 395-7780.

As of April 1, 2025, you cannot walk in without an appointment. Call ahead to schedule before you go. Both parties must appear at the same time during the application window: Monday through Friday, 8:00 to 11:30 AM and 1:00 to 3:30 PM. The office closes for lunch. If you arrive during the lunch break, you will have to wait or reschedule.

Newark also has a branch location of the Office of Vital Statistics for ordering certified copies of marriage certificates. That branch is at 258 Chapman Road, Newark, DE 19702. Both parties must come together to the Clerk's office. You cannot do this separately. Each person needs a valid government-issued photo ID with their date of birth. Acceptable IDs include a Delaware driver's license, a DMV-issued ID card, a passport, a consulate ID, or a military ID for active duty members. You also need proof of your current address to qualify for the resident fee.

The fee is $70 if at least one of you is a Delaware resident. If neither of you lives in Delaware, the fee is $120. Both amounts include the $20 recording charge. Bring these amounts as payment. Unlike Kent County, New Castle County may accept other payment methods, but confirm at the time you book your appointment.

If either party was previously married, bring an original or certified copy of the final divorce decree, annulment papers, or death certificate. Photocopies are not accepted. If a name change was part of a prior divorce, bring original or certified name change documents. A third-party translator is required if one party does not speak English; the translator must be 18 or older with valid ID. You will need to know both your parents' maiden names and your own birthplace.

Newark Vital Records and Marriage Certificates

Delaware Marriage License Rules for Newark
