How to officiate a wedding in Delaware City Delaware

Both parties must appear in person at the Clerk's office at the same time. You cannot come on separate days. Each person needs a valid government-issued photo ID that includes a date of birth. A state driver's license, DMV ID card, passport, consulate ID, or active duty military ID all work. Proof of your current Delaware address is required to get the resident fee of $70. Non-residents pay $120. Both amounts include the $20 recording charge.

You'll be asked for your parents' birth names (maiden names), your birthplace, and your current address. If either party was previously married, bring original or certified copies of the divorce decree, annulment, or death certificate. No photocopies. If one party doesn't speak English, a translator is required who is 18 or older with valid ID. If either party is on probation or parole, bring an original letter from the Probation Officer. All applicants must be 18 or older.

License Rules for Delaware City

The same statewide rules apply here. You must apply at least 24 hours before the ceremony. The license is valid for 30 days. If you don't use it in time, it expires and cannot be reinstated. The fee is nonrefundable. The ceremony must take place somewhere in Delaware.

After the ceremony, the officiant returns the completed license to the Clerk of the Peace within 4 days and sends copies to the Office of Vital Statistics within 5 days. If the officiant is a member of the clergy, they must be registered with the Clerk of the Peace in the county where the ceremony takes place. Judges, justices of the peace, and the Wilmington city mayor may also officiate marriages.

Who Can Perform Marriages in Delaware City

Delaware City is an incorporated municipality. That means the city's chief executive officer (mayor) may legally solemnize marriages within the city limits under Delaware law.
