As of April 1, 2025, walk-in visits are not accepted at New Castle County. You must call ahead and schedule an appointment before you go. Both parties must arrive together. The application window is Monday through Friday, 8:00 to 11:30 AM and 1:00 to 3:30 PM. The office does not take new applications during the lunch break.

New Castle Marriage License Fees
The fee for New Castle County residents is $70 total, which includes the $20 recording fee. Non-residents pay $120, also inclusive of the recording fee. If only one applicant is a Delaware resident, you qualify for the lower rate as long as that person can show proof of their Delaware address. Fees are nonrefundable once the license is issued.
New Castle County's office closes for lunch and accepts a variety of payment methods, unlike Kent County which is cash only. Fees are set at the county level, so they can differ slightly from what third-party sites publish. Confirm the exact current amounts by calling the office before your visit.
The application process takes about 20 to 30 minutes from start to finish. Your issued license will carry the Clerk of the Peace's signature and county seal, along with a certificate of marriage section to be signed by your officiant and witnesses at the ceremony.

What New Castle City Applicants Need
Both applicants must come in together at the time of the scheduled appointment. Neither party can apply alone or send someone else in their place. Each person needs a valid government-issued photo ID showing their date of birth. Acceptable IDs include a state driver's license, DMV ID card, passport, consulate ID, or active duty military ID. Proof of current Delaware address is required to get the resident rate.
You will be asked to provide both parents' maiden names, your birthplace (state or country only), and your current mailing address. If either party was previously married, bring original or certified copies of the divorce decree, annulment, or death certificate. Photocopies are not accepted. If you have legally reclaimed a former name after a divorce, bring the original name change court documents as well.
A third-party translator is required if one party does not speak English. The translator must be at least 18 years old and have their own valid photo ID. An original letter from a Probation or Parole Officer is required if either applicant is on supervision. All applicants must be 18 or older. Delaware has a complete ban on child marriage with no exceptions.
Marriage License Rules for New Castle
All standard Delaware rules apply. You must apply at least 24 hours before your ceremony. The 24-hour window starts from the exact time of application. The license is valid for 30 days. If the ceremony doesn't happen in time, the license expires. No refunds. No reinstatements. You'd apply and pay again from scratch.
The license can be used anywhere in Delaware, not just in New Castle County or New Castle City. After the ceremony, the officiant signs the license along with the couple and any witnesses, then returns the completed license to the Clerk of the Peace within 4 days. Copies go to the Office of Vital Statistics within 5 days.
Clergy who perform ceremonies in New Castle County must be registered with the Clerk of the Peace. Out-of-state clergy must also register before performing any ceremony in the county. Judges and the mayor of any incorporated municipality may also officiate within their jurisdiction.
