What You Need When You Apply
Both applicants must show up together at the Clerk's office. Each person needs a valid government-issued photo ID with their date of birth on it. A Delaware driver's license or DMV ID, a passport, a consulate ID, or an active duty military ID all work. Proof of your current address is needed to qualify for the $70 resident fee. Only one of you needs to be a Delaware resident to get the lower rate. The non-resident fee is $120. Both amounts include the $20 recording charge.
Be ready to provide your parents' birth names (maiden names), your place of birth (state or country), and your current address. If either of you was previously married, bring an original or certified copy of the divorce decree, annulment, or death certificate. No photocopies accepted. Name change documents are needed if you legally reclaimed a former name after a divorce. A certified translation is required for foreign-language documents.
A translator is needed if one party doesn't speak English. The translator must be 18 or older and carry valid ID. Any applicant on probation or parole must bring an original letter of permission from their Probation Officer. All applicants must be at least 18. Delaware does not permit underage marriages under any circumstances.
